This bill is completely unnecessary. In my opinion, the concerns expressed in the bill are already taken into consideration in the engineering investigation. While the 85th percentile is certainly a factor, it isn't the only parameter considered when selecting the appropriate speed for a given route. Factors such as land use, crash history, horizontal and vertical geometrics, conflict points, etc are given due consideration when developing a recommendation.
The thing in caps in the end that the DOT shall "consider" is pretty useless as this is permissive. These types of traffic control devices are already available for use and are generally considered.
